Settling Outside of Court
Opting for a court trial can often feel like placing the intricacies of your life in the judge’s hands, relinquishing control over personal and often emotive decisions.
Recognizing this, we advocate, whenever possible, for settling outside of court as it empowers you to maintain a higher degree of influence over the outcomes that shape your post-divorce life.
At our firm, we ardently believe in the power of dialogue and negotiation.
By engaging in direct conversations with the opposing side, we seek to find common ground, fostering an environment where mutually beneficial agreements can be reached.
This approach not only preserves your autonomy but also promotes a sense of collaboration, potentially easing future interactions between both parties.
In instances where direct negotiation might prove challenging, we are experienced in utilizing divorce mediation as an effective alternative.
Mediation offers a neutral, confidential space where both parties can voice their concerns, express their needs, and work toward compromise under the guidance of a trained mediator.
This process encourages open communication and can often lead to resolutions that are more personalized and satisfactory for everyone involved.
Settling outside of court also tends to be more cost-effective and time-efficient, alleviating some of the financial and emotional stresses associated with divorce.
It allows for more flexible, creative solutions that address the unique aspects of your situation, enabling a smoother transition into the next chapter of your life.
We are dedicated to exploring all available avenues to achieve a resolution that aligns with your goals and values.
By prioritizing out-of-court settlements, we aim to place control back in your hands, ensuring that the decisions made are reflective of your desires and conducive to a positive future.
Experienced Litigators
Regrettably, the path to resolution in a divorce is not always paved with mutual agreements and amicable settlements.
There are instances where the differences between you and your ex are too vast, and the room for negotiation narrows to a close.
In such challenging situations, it becomes imperative to have a formidable litigator on your side, ready to present your case with vigor and precision to a judge.
Our team comprises seasoned litigators who excel in the courtroom setting.
Armed with extensive experience, sharp legal acumen, and a passion for advocating for our clients, we are prepared to navigate the intricacies of litigation to uphold your interests.
We understand that each case brought before the court is unique, and we tailor our approach to highlight the strengths of your position, ensuring your voice is heard and your concerns are addressed.
Being well-versed in the art of litigation means we are adept at constructing compelling narratives, presenting persuasive arguments, and diligently cross-examining to uncover the truth.
Our meticulous preparation and attention to detail enable us to anticipate opposing arguments and formulate strategic responses, thereby strengthening your stance.
While we always strive for amicable solutions, we are unyielding when it comes to protecting your rights and securing favorable outcomes.
Our commitment is unwavering, whether it involves fiercely advocating for fair asset division, child custody arrangements, or support agreements.
With our experienced litigators by your side, you can feel confident and supported as we navigate the complexities of the courtroom together.

What Else Should You Know About Divorce?
Fault Is Not an Issue in a Colorado Divorce
Colorado is a no-fault divorce state. This implies that there is no requirement for either spouse to allege wrongdoing by the other to initiate a divorce.
In a no-fault divorce state, a party only has to state that the marriage is “irretrievably broken” in order to proceed with a divorce, or “dissolution of marriage,” as it is referred to in Colorado.
Are You a Colorado Resident?
To be eligible to file for divorce in Colorado, at least one spouse must be a resident of the state and for a minimum of 91 days prior to filing.
How Long Do You Have to Wait?
Colorado has a mandatory 91-day waiting period from the time the divorce petition is filed and served to the other spouse before a divorce can be finalized.
However, it is not uncommon for the divorce process to extend beyond this period, depending on the complexities involved and the availability of the court.
Marital Property May Not Be Split 50/50
Colorado is an equitable distribution state. This means marital property will be divided in a manner that is deemed fair and equitable but not necessarily equal.
Will There Be Spousal Support?
In Colorado, spousal Support or Alimony are referred to as spousal maintenance.
This form of support is not guaranteed and depends on several factors, including the financial resources of each party, the duration of the marriage, and the standard of living established during the marriage.
Child Support Calculation
Child support in Colorado is calculated using a formula that takes into account both parents’ incomes, the number of overnight stays the child has with each parent, and any additional expenses related to the child.
Allocation of Parental Responsibilities
The child custody process is referred to as the allocation of parental responsibilities (APR) in Colorado.
The court determines custody based on the best interest of the child, taking into consideration the child’s and parents’ preferences, the child’s adaptability to home, school, and community, as well as the mental and physical well-being of all parties involved.
The Requirement of Mediation
Most Colorado counties require parties to mediate before advancing to a court hearing with the hope that parties can resolve disputes, especially those related to parenting responsibilities, without going to trial.
Modification of Orders
Post-divorce, there is a possibility for modification of certain orders, such as child support, spousal support, and parenting time.
These post-decree modifications are typically contingent on substantial changes in the circumstances of one or both parties.
Legal Representation
While it’s possible to represent yourself in a divorce, it’s often advisable to seek legal representation to protect your interests, especially if the divorce is contested or involves complex assets, debts, or child custody issues.
